1. Service Provider
The "Stampista Scanner" service, available at stampista.com, is provided by Fabio Ferrari, a natural person not carrying on a business activity, Italian tax code FRRFBA96R18B774C, residing at Piazzale Cuoco 5, Milan, Italy, reachable at contact@stampista.com.
2. Description of the Service
Stampista Scanner is an automated search engine for similar products: it lets 3D model designers upload the STL file of their own product and find web pages showing visually or conceptually similar physical products. The platform accepts STL files only (synthetic 3D models): photos and videos cannot be uploaded. For each result the service computes one or more automatic similarity metrics (see Section 6), used solely to find and rank results by relevance. The service is offered free of charge within a monthly per-user search limit and an overall shared limit tied to the availability of the third-party reverse-image search providers. At the user's request, the service can run periodic automatic checks (weekly, biweekly, or monthly) on saved products, with optional email notification, and provides an in-app channel for submitting requests and reports to the provider.
3. Registration and Account
Using the service requires creating an account with a name/nickname, a valid email address, and a password. You represent that you are at least 18 years old and that the information you provide is accurate. You are responsible for keeping your credentials confidential and for all activity under your account. Registration requires explicit acceptance of these Terms and our Privacy Policy.
4. Uploaded Content and Intellectual Property
You retain full ownership of the rights to the STL files you upload. By uploading content, you grant the service provider a limited, non-exclusive, revocable license to use, store, and transmit that content solely to provide the requested service (including transmission to strictly necessary third-party providers, e.g. the reverse-image search service and the image-matching microservice). STL files receive heightened confidentiality treatment as described in the Privacy Policy: they are never made publicly accessible and are not permanently retained by the matching microservice.
You represent and warrant that you have the right to upload the content you provide and that it does not infringe the intellectual property or other rights of any third party.
5. Prohibited Uses
You may not use the service to:
- upload unlawful, defamatory content, or content that infringes third-party rights;
- harass, defame, or falsely accuse third parties based on the service's results;
- attempt to circumvent usage limits, security measures, or restricted access to STL files;
- systematically scrape the platform or automate access without authorization;
- resell or redistribute access to the service without written authorization.
6. Nature of the Service and Limitation of Liability
Note: the semantic-coherence score (based on the product name, description, and tags) is currently disabled for technical reasons. Only the visual-similarity percentage is computed and shown. The sections below still describe how the full score works.
Stampista Scanner is solely an automated search engine that, starting from the content you upload, finds web pages showing similar products. For each result the service computes one or more similarity metrics - a visual-similarity percentage and, when you provide a description or tags, a coherence percentage with that text, combined into an overall score. This score is solely a technical tool to find and rank results by relevance: it expresses no judgment and does not label or imply that any product or third-party seller is a copy, a counterfeiter, an unfair competitor, or otherwise the author of any wrongdoing. The platform assigns no qualitative labels and gives no result any meaning beyond "product potentially similar to the one searched."
The similarity score has no evidentiary or legal value and does not constitute a finding of intellectual property infringement, proof that a product is sold without a license, legal advice, or a judgment on any party's conduct or good faith. Verifying whether an infringement actually exists, ascertaining that a product is truly sold without the necessary licenses, and any due-diligence activity fall entirely outside the service and remain your sole responsibility. Likewise, any data, image, screenshot, percentage, or other element obtained through the platform has no legal or evidentiary value and is not intended to be used as evidence in any forum.
Results are generated by an automated process, are not verified by a person before being shown, and may be inaccurate, incomplete, or misleading (false positives and false negatives). Content relating to third parties shown in results (URLs, product images, domain) is obtained via third-party search services from publicly accessible web sources; the service provider does not independently verify the accuracy of this data and does not control its content.
You are solely responsible for interpreting the results, for any independent verification, and for any action (including contacting third-party sellers, cease-and-desist letters, or legal proceedings) taken based on them. Any dispute or legal liability arising from such actions is solely between you and the third party concerned: the service provider remains entirely extraneous to it. You agree to indemnify and hold harmless the provider from any claim, damage, or cost arising from use of the results or from action you take against third parties identified by the service.
7. Reporting and Removing Content
Anyone who believes a result shown by the service contains inaccurate, harmful, or unlawful information about them - including third parties identified in search results - may report it by writing to contact@stampista.com, specifying the result URL and the reasons for the report. We will review the report and provide a reasoned response within a reasonable time, with the possibility of removing the result from visible results.
Likewise, the operator of a website or platform (for example a marketplace) that does not want its content or links to its pages to appear among the service's results may request their removal by writing to contact@stampista.com, indicating the domain or URLs concerned. We will manually exclude that domain from visible results within a reasonable time.
8. Service Availability and Usage Limits
The service is provided "as is" and "as available," without guarantee of continuous operation. Search functionality depends on a third-party provider (SerpAPI/Google Lens, used for the renders generated from STL files) subject to its own availability and usage limits; if the shared monthly capacity is exhausted, the service may temporarily suspend new searches until the period resets. We reserve the right to modify, suspend, or discontinue the service, in whole or in part, with notice where reasonably possible.
9. Limitation of Liability
To the maximum extent permitted by applicable law, the service provider is not liable for indirect or consequential damages or loss of profit arising from use of, or inability to use, the service. Nothing in these Terms excludes or limits liability for willful misconduct, gross negligence, or personal injury, to the extent such exclusion is not permitted under applicable Italian law, including consumer protection law for users who qualify as consumers.
10. Suspension and Account Termination
You may delete your account at any time. We reserve the right to suspend or delete accounts that violate these Terms, with notice to the user where possible. Upon account termination, data is handled as described in the Privacy Policy.
11. Changes to These Terms
We reserve the right to modify these Terms. Material changes will be communicated by email or via a notice on the site with reasonable advance notice; continued use of the service after changes take effect constitutes acceptance of them.
12. Governing Law and Jurisdiction
These Terms are governed by Italian law. For users who qualify as consumers under the Italian Consumer Code, the exclusive competent forum is that of the consumer's place of residence or domicile. For users acting in the course of a business or professional activity, the exclusive competent forum is the Court of Milan, Italy.
